I don't find in jmp 10 in the preferences the "use Excel labels as Heading "Always"" like in jmp9, so the problem is, that the first column in an excel spreadsheet isn't recognized as a heading.

If I open it manually I can choose - always enforce ExcelRow1 as labels:
but it isn't saved for the next excel file and that ist frustrating, because every script with excel import doesnt work either in jmp10.
Is there any solution to this problem?

Click on JMP in the Excel toolbar, then click on "preferences". You will see where to check the box for "Use first rows as column names"
